Welcome to GetFood, a multivendor online ordering platform operated by Vhizy LLC ("Vhizy," "we," "us," or "our"), located at 8 The Grn Ste 12788, Dover, DE 19901. These Terms of Service ("Terms") govern your access to and use of the GetFood website (www.get.food.com), mobile application, and related services (collectively, the "Platform"). By accessing or using the Platform, you ("you," "your," or "user") agree to be bound by these Terms, which form a legally binding agreement between you and Vhizy LLC.

1. Acceptance of Terms

You must be at least 18 years old (or the age of majority in your state) to use the Platform. If you do not agree with these Terms, do not use the Platform. We may update these Terms periodically, and we will notify you of material changes via email, in-app notifications, or by posting the updated Terms on the Platform. Continued use after such changes constitutes acceptance.

2. Description of Services

GetFood connects users with restaurants, grocery stores, and retail shops ("Merchants") to place orders for food, groceries, or other products, which may be delivered by independent delivery personnel ("Couriers") or picked up by you. We are not a restaurant, retailer, or delivery service but a technology platform facilitating these transactions. Merchants and Couriers are independent third parties, not employees or affiliates of Vhizy.

3. User Accounts

  • Registration: To use certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

  • Security: Notify us immediately at [email protected] if you suspect unauthorized access to your account.

  • Termination: We may suspend or terminate your account for violations of these Terms, fraudulent activity, or at our discretion, with or without notice.

4. Placing Orders

  • Order Process: You select items from Merchant menus, provide delivery or pickup instructions, and submit payment through the Platform. Orders are subject to Merchant availability and acceptance.

  • Pricing and Fees: Prices are set by Merchants, and additional fees (e.g., delivery, service, or taxes) may apply, as disclosed at checkout. All charges are in U.S. dollars.

  • Payments: Payments are processed securely via third-party payment processors. You authorize us to charge your selected payment method for all applicable charges.

5. User Conduct

You agree not to:

  • Use the Platform for illegal, fraudulent, or unauthorized purposes.

  • Misrepresent your identity or submit false information.

  • Interfere with the Platform’s functionality, including introducing viruses or malicious code.

  • Harass, discriminate against, or harm Merchants, Couriers, or other users.

  • Copy, modify, or distribute Platform content without permission.

6. Intellectual Property

All content on the Platform, including text, logos, images, and software, is owned by Vhizy LLC or its licensors and protected by U.S. copyright, trademark, and other laws. You may not reproduce, distribute, or create derivative works without our express written consent.

7. Third-Party Services

The Platform may integrate third-party services (e.g., payment processors, maps, or analytics tools). These services are subject to their own terms and policies, and we are not responsible for their performance or practices.

8. Disclaimers

  • As-Is Basis: The Platform is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

  • Third-Party Actions: We do not control or guarantee the quality, accuracy, or timeliness of Merchant products or Courier deliveries.

  • Availability: We do not guarantee uninterrupted access to the Platform and may perform maintenance or updates without notice.

9. Limitation of Liability

To the fullest extent permitted by law, Vhizy LLC, its affiliates, officers, directors, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Platform, even if advised of the possibility of such damages. Our total liability shall not exceed the amount you paid us for the specific order giving rise to the claim.
State-Specific Note: In states like California and New York, certain limitations may not apply if prohibited by consumer protection laws.

10. Indemnification

You agree to indemnify and hold harmless Vhizy LLC and its affiliates from any claims, losses, or damages, including legal fees, arising from your use of the Platform, violation of these Terms, or infringement of third-party rights.

11. Governing Law and Dispute Resolution

  • Governing Law: These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles, except where preempted by federal law or state-specific consumer protections (e.g., California’s Consumer Legal Remedies Act).

  • Arbitration: Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Dover, Delaware, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. You waive the right to participate in class actions or class arbitrations.

  • Small Claims: You may pursue claims in small claims court in your jurisdiction if eligible.

  • State-Specific Note: In California, Florida, and New York, you may have additional rights to seek remedies through state agencies or courts for certain violations.

12. Termination

We may terminate or suspend your access to the Platform at any time for violations of these Terms, legal requirements, or at our discretion. Upon termination, your account and right to use the Platform will cease, but provisions such as Limitation of Liability and Indemnification will survive.

  • California: We comply with the CCPA, California Business and Professions Code, and other consumer protection laws. You may contact the California Attorney General for complaints.

  • Florida: We adhere to Florida’s data privacy and consumer protection laws, including transparency in pricing and refunds.

  • New York: We comply with the SHIELD Act and New York’s fee cap regulations for delivery platforms, where applicable.

  • Delaware: As a Delaware LLC, we follow state business and data security regulations.

  • All States: We strive to meet the highest standards of consumer protection across all 50 states, including menu labeling, pricing transparency, and data security.

15. Miscellaneous

  • Entire Agreement: These Terms, along with our Privacy Policy, Cookie Policy, and Refund Policy, constitute the entire agreement between you and Vhizy LLC.

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

  • No Waiver: Our failure to enforce any right does not waive that right.

  • Assignment: You may not assign these Terms without our consent; we may assign them freely.
